What Happens if a Debt Collector Doesn’t Respond to my Request?

I was recent asked, “What are the consequences if the debt collector fails to provide verification under FDCPA?”

Believe it or not, there are none. If you have timely requested verification under the FDCPA, a debt collector is under no duty or obligation to provide that information to you. HOWEVER, they are not allowed to continue to collect on the debt until the verification is provided. So, if they simply walk away and do not further attempt to collect on the debt, they have not violated the FDCPA.
You may want to check your credit report if they have not verified the debt. Posting the account on your credit report is an attempt to collect a debt and may be a violation of the FDCPA if the continue to report it during the verification period.
